This paper argues that it is prudentially wise to defer to groups about how they are essentially constituted and defined. After a few words situating the paper in my greater research project (§1), I articulate the kind of deference I have in mind (§2). Then I offer two conditional arguments on why it is epistemically desirable to let other people tell you how they ought to be identified (§3). The first argument is that people are owed lexical sovereignty because denying (...) it is absurd; the second is that modest skeptics ought to agree with it on the basis of some relatively anodyne and plausible epistemic considerations. Considerable recent research in neurosciences has dealt with the topic of consciousness, even though there is still disagreement about how to identify and classify conscious states. Recent behavioral work on the topic also exists. We survey recent behavioral and neuroscientific literature with the aims of commenting on strengths and weaknesses of the literature and mapping new directions and recommendations for experimental psychologists. We reconcile this literature with a view of human information processing (Cowan, 1988; Cowan et al., 2024) in which (...) a capacity-limited focus of attention is embedded within the activated portion of long-term memory, with dual bottom-up and top-down control of the focus of attention. None of the many extant theories fully captures what we propose as the organization of conscious thought at cognitive and neural levels. It seems clear that information from various cognitive functions, based on signals from various brain areas, is integrated into a conscious whole. In our new proposal, the integration involves funneling information to a hub or focus of attention neurally centered in the parietal lobes and functionally connected to areas representing the currently attended information. This funneling process (bringing information from diverse sensory and frontal sources to contact a small parietal area where attended information is coordinated and combined) may be the converse of global broadcasting, from other proposals (Baars et al., 2021; Baars & Franklin, 2003; Dehaene & Changeux, 2011). The proposed system incorporates many principles from previous research and theorization and strives toward a resolution of the relation between consciousness and attention. This study examined the relationship between psychopathy and two components of empathy including a cognitive component (e.g., perspective-taking ability) and an affective component (e.g., compassion) in a community sample. The Psychopathic Personality Inventory Short Form was used to assess psychopathy and several psychological measures were used to test empathy including the Interpersonal Reactivity Index, the Diagnostic Analysis of Nonverbal Accuracy-2, and the Test of Self Conscious Affect -3. Across instruments, psychopathy (as a unitary construct) appeared to be negligibly correlated with (...) perspective-taking scales and negatively correlated with the affective components of empathy. Findings indicated that the emotional deficits were noted most prominently for the behavioral component of psychopathy. Results also showed that higher psychopathy scores in community participants were linked to higher levels of antisocial conduct. (shrink)

It is often argued that the indispensability of continuum models comes from their empirical adequacy despite their decoupling from the microscopic details of the modelled physical system. There is thus a commonly held misconception that temperature varying across a region of space or time can always be accurately represented as a continuous function. We discuss three inter-related cases of temperature modelling — in phase transitions, thermal boundary resistance and slip flows — and show that the continuum view is fallacious on (...) the ground that the microscopic details of a physical system are not necessarily decoupled from continuum models. We show how temperature discontinuities are present in both data (experiments and simulations) and phenomena (theory and models) and how discontinuum models of temperature variation may have greater empirical adequacy and explanatory power. The conclusions of our paper are: a) continuum idealisations are not indispensable to modelling physical phenomena and both continuous and discontinuous representations of phenomena work depending on the context; b) temperature is not necessarily a continuously defined function in our best scientific representations of the world; and c) that its continuity, where applicable, is a contingent matter. We also raise a question as to whether discontinuous representations should be considered truly de-idealised descriptions of physical phenomena. (shrink)

What follows is an attempt to do some conceptual housekeeping around the notion of secret law as provided by Christopher Kutz (2013). First I consider low-salience (or merely obscure) law, suggesting that it fails to capture the legal and moral facts that are at stake in the case which Kutz used to motivate it. Then I outline a theoretical contrast between mere obscurity and secrecy, in contrast to the 'neutral' account of secrecy provided by Sissela Bok (1989). The upshot of (...) the two sections is that low-salience law is neither secret law nor necessarily problematic, though it closely resembles a kind of law that is both secret and problematic: namely, those legal obscurities that subvert manifest interests related to the informational needs of citizens. The ensuing argument undermines the fiction of constructive presence found in Austin and Blackstone. (shrink)

So-called ‘distinctively mathematical explanations’ (DMEs) are said to explain physical phenomena, not in terms of contingent causal laws, but rather in terms of mathematical necessities that constrain the physical system in question. Lange argues that the existence of four or more equilibrium positions of any double pendulum has a DME. Here we refute both Lange’s claim itself and a strengthened and extended version of the claim that would pertain to any n-tuple pendulum system on the ground that such explanations are (...) actually causal explanations in disguise and their associated modal conditionals are not general enough to explain the said features of such dynamical systems. We argue and show that if circumscribing the antecedent for a necessarily true conditional in such explanations involves making a causal analysis of the problem, then the resulting explanation is not distinctively mathematical or non-causal. Our argument generalises to other dynamical systems that may have purported DMEs analogous to the one proposed by Lange, and even to some other counterfactual accounts of non-causal explanation given by Reutlinger and Rice. There at least three ways of thinking about rationality: instrumental, substantive, and intentional. By far, the instrumental account is most influential. This essay proposes that intentional rationality can provide substantive accounts with room to breathe, and in a way that is facially distinct from instrumental accounts. I suggest that the intentionality of a judgment is made up of what it is about and the orientation through which it is judged, while irrationality is the subversion of a strict supporting connection between (...) the judgment and its corresponding set of coordinated attitudes (reasons). It follows that irrational intentionality is made up of episodic states where a judgment is subverted because of a misalignment between what it is about and the way the judge is oriented towards its contents. Four examples of irrational intentionality are considered: passivity towards ends, constitutive ignorance towards facts, delirious paranoia towards objects, and a disjunctive orientation towards categorizations. This paper explores the possibility that Hobbesian jurisprudence is best understood as a ‘third way’ in legal theory, irreducible to classical natural law or legal positivism. I sketch two potential ‘third theories’ of law -- legal pragmatism and legal dualism -- and argue that, when considered in its broadest sense, Leviathan is best viewed as an example of legal pragmatism. I consider whether this legal pragmatist interpretation can be sustained in the examination of Leviathan’s treatment of civil law, and argue (...) that the pragmatic interpretation can only be successful if we can resolve two textual issues in that chapter. First, while Hobbes argues that law entails the existence of public (sharable) reasons, he does not adequately defend the view that the sovereign is the unique authority over such reasons in all cases, especially as far as they concern known collective emergencies. Second, Hobbes both affirms and denies that a sovereign can fail to do justice, which is paradoxical. Both problems are best resolved by legal pragmatism, though the second problem resists a fully satisfying resolution. The upshot is that, although Leviathan ought to be regarded as an episode of legal pragmatism, there are trade-offs on every reading. (shrink)

In this paper, I outline a theory of social kinds. A general theory of social kinds has to set out at least three conditions: existence conditions, persistence conditions, and identity conditions. For the sake of expediency, I focus on the existence and persistence conditions. The paper is organized just as life: first with existence, then persistence. I argue that anti-realism is more attractive than realism as an account of the existence conditions, despite the fact that realism has been under-appreciated. Then (...) I argue for a particular theory of the persistence conditions, which I call the basic overlapping traits theory (BOTT), based on an analogy to an approach to personal identity. The upshot of the argument is that from an anti-realist metaphysics we have the capacity to discuss a wider diversity of social phenomena. (shrink)

In this paper I argue that textualism is far less attractive as a theory of written law than some of its modern proponents think. For it is not usually sensible to expect the grammatical meaning of a provision to determine its appropriate legal meaning. Factors that are unrelated to grammar in the identification of law (e.g., legal theory, context) do too much of the work. **Draft -- acknowledgments welcome, but please do not cite.**.

The very idea of promulgation has been given little to no treatment in the philosophy of law. In this exploratory essay, I introduce three possible theories of promulgation: the ‘no-theory theory’ (which treats promulgation as a matter of particular contexts), the ‘conveyance theory’ (which treats promulgation as a function of intellectual good faith interpreters), and ‘agonistic theory’ (which treats promulgation as indistinguishable from propaganda). I suggest that (at least) three kinds of models are consistent with the theories, and can potentially (...) help us understand when law is successfully promulgated in particular legal contexts: the spread model, the chain model, and the memetic model. I end the paper by comparing the two theories with respect to a case study. Throughout I will show that the conveyance and agonistic theories have a serious advantage over the no-theory theory, in that they allow us to comparatively examine the epistemic weaknesses of diverse theories about the grounding of law on the basis of their contents. There is a major debate as to whether there are non-causal mathematical explanations of physical facts that show how the facts under question arise from a degree of mathematical necessity considered stronger than that of contingent causal laws. We focus on Marc Lange’s account of distinctively mathematical explanations to argue that purported mathematical explanations are essentially causal explanations in disguise and are no different from ordinary applications of mathematics. This is because these explanations work not by appealing to what the (...) world must be like as a matter of mathematical necessity but by appealing to various contingent causal facts. (shrink)

In a recent issue of Philosophy East and West Douglas Berger defends a new reading of Mūlamadhyamakakārikā XXIV : 18, arguing that most contemporary translators mistranslate the important term prajñaptir upādāya, misreading it as a compound indicating "dependent designation" or something of the sort, instead of taking it simply to mean "this notion, once acquired." He attributes this alleged error, pervasive in modern scholarship, to Candrakīrti, who, Berger correctly notes, argues for the interpretation he rejects.Berger's analysis, and the reading (...) of the text he suggests is grounded on that analysis, is insightful and fascinating, and certainly generates an understanding of Nāgārjuna's enterprise that is welcome .. Nicole Hassoun’s sufficientarian theory is based on a particular conception of caring, which she calls ‘care, simpliciter’. However, ‘care, simpliciter’ is not described in any detail. This essay tries to offer a critical revision of Hassoun’s concept of care in a way that would put the MGL theory on its strongest footing. To that end, I will contrast her view with a taxonomy of care that supplements the accounts of care provided by Stephen Darwall and Lori Gruen. This paper focuses on how building human potentialities in education can enhance learning competencies in students for the development of the self and the society. Human potential refers to a possibility human beings are capable of achieving. Montessori believes that the traditional system of education directs students to learn through memorization and recitation techniques and does not lay much emphasis on helping students to bring out their maximum potential. What goal can we attribute to education today? Our focus shall be (...) to answer the questions, what are the favorable conditions under which education can help to build human potentialities? Is Montessori’s view essential in enhancing creativity and building the necessary competencies of the learners in our society today? Education is a natural process carried out by the human individual. It is not what the teacher gives and is not acquired by listening to words but by experiences upon the environment. Montessori opts that education should help the learners develop confidence in their emerging abilities and offer them the opportunity to gain independence in daily tasks. The pedagogic significance of this work serves as a guide for the educational system in Africa and Cameroon in particular. It serves as a guide for curriculum developers and policy makers to bring out programs that will enhance the building of individual competencies for eventual development. Thus Montessori’s idea of education to build human potentialities is indispensible to our educational system today. (shrink)

This paper advocates a new reading of Nelson Goodman’s new riddle of induction. According to Ian Hacking, this famous problem conveys a “pure nominalism”, as it grounds Goodman’s denial regarding the existence of natural kinds. While this interpretation is somewhat convincing, it suffers the major flaw of not corresponding to what Goodman himself understood by “nominalism”. Nominalism, in a goodmanian sense, is indeed primarily a technical demand, which stems from the so-called “calculus of individuals”. I argue that this mereological (...) definition of nominalism allows to understand the new riddle of induction afresh. As a result, Goodman’s riddle is “hyper-nominalist”, i.e., nominalist in a distinct and stronger sense than what Hacking suggested. (shrink)

OBJETIVO -/- O estudante de Zootecnia e de Veterinária, quando se depara com a produção animal, um dos pilares importantes é a reprodução, uma vez que é a perpetuação da espécie, seja para gerar filhas de uma vaca campeã em produção leiteira e de um touro com rusticidade e com aptidão produtiva de corte, ou mesmo para reposição de um plantel, o mesmo deve estar consciente de que esse ramo é de extrema responsabilidade, já que estará intimamente lidando com a (...) vida e com um investimento que pode gerar lucros em demasia para a propriedade ou, se mal feito o manejo da reprodução, trazer sérios transtornos para a mesma. -/- Nesse trabalho, o estudante revisará os sucessos da puberdade e estacionalidade reprodutiva relacionando-os com os processos endócrinos e os fatores que afetam sua manifestação como os nutricionais, para compreender a maneira ao qual podem ser manipuladas. -/- -/- • _____INTRODUÇÃO -/- A puberdade marca o início da vida reprodutiva do animal, permitindo integrar o indivíduo ao seu ciclo produtivo. A estacionalidade é uma característica de adaptação que algumas espécies desenvolveram para fazer garantir a eficiência da reprodução e a sobrevivência dos filhotes. -/- -/- • _____PUBERDADE -/- A puberdade é atingida quando o animal é capaz de produzir e liberar gametas viáveis e funcionais (férteis). Na fêmea esse fato ocorre na primeira ovulação, que geralmente coincide com a manifestação do comportamento do cio; e nos machos durante a primeira ejaculação com espermatozoides viáveis. -/- Do ponto de vista da produção animal, puberdade prematura ou precoce, é importante para poder permitir a incorporação dos animais ao ciclo produtivo o mais rapidamente possível. No caso de touros holandeses, por exemplo, é desejável que produzam sêmen precocemente para incorporá-los a prova de progênie; nas fêmeas, entretanto, deve-se considerar que nem sempre é conveniente usar o primeiro ciclo ou cio para reprodução. É o caso das marrãs (porcas primíparas), onde é benéfico esperar até o segundo ou terceiro estro para aumentar o tamanho da ninhada. Também pode ser vantajoso esperar que o indivíduo alcance sua maturidade sexual, que ocorre quando a fêmea consegue se reproduzir sem sofrer efeitos adversos. A ovelha nascida na primavera, por exemplo, pode engravidar no outono seguinte e dar à luz no primeiro ano de vida, mas seu crescimento pode ser afetado; o mesmo ocorre com a novilha, em que o acasalamento precoce pode promover distorcia por falta de desenvolvimento pélvico. -/- A puberdade é um processo gradual e está intimamente relacionada à taxa de crescimento e ao metabolismo energético. O recém-nascido usa energia para funções vitais, principalmente termorregulação; esse feito se deve ao fato de os jovens possuírem uma superfície corporal muito elevada em relação ao seu volume. Durante o desenvolvi-mento subsequente dos tecidos também há prioridade no uso de nutrientes, que inicialmente favorecem o desenvolvimento do tecido ósseo e muscular, e uma vez que estes atingem determinado tamanho de acordo com as condições genéticas do indivíduo, inicia-se o desenvolvimento do tecido adiposo, que é indicativa de um reservatório de energia. É importante ressaltar que existe uma interação entre a genética e o meio ambiente, de forma que o potencial genético só será expresso se o meio ambiente for favorável. -/- Para que a ovulação ocorra, é necessário considerar o funcionamento do eixo hipotálamo-hipófise-gonodal. O aumento da frequência pulsátil do GnRH hipotalâmico e em consequência do LH hipofisário provoca a maturação do folículo em nível gonodal, o que aumenta a produção de estrógenos. O aumento dos estrogênios causa, por feedback positivo no hipotálamo, a liberação do pico pré-ovulatório de LH e, consequentemente, a ovulação. Na fase pré-púbere, a frequência dos pulsos de GnRH e LH é muito baixa e insuficiente para provocar a maturação folicular, pois o hipotálamo é inibido e, portanto, não ocorre ovulação. -/- A geração pulsátil de GnRH no momento reprodutivo adequado para desencadear o início da puberdade depende de uma rede neural complexa que, além dos neurônios GnRH, inclui outros neurônios e células da glia; ele também integra vários sinais internos e externos para o corpo. A morfologia dos neurônios GnRH também é única, uma vez que seus dendritos também podem funcionar como axônios, dando-lhes uma função distinta. A geração de pulsos também indica a necessidade de sincronização entre subpopulações de neurônios GnRH, que, acima de tudo, parece ser extrínseca a esses neurônios e envolve múltiplos hormônios e neurotransmissores -/- Se dois níveis de conexões aferentes são considerados, estima-se que cada neurônio de GnRH pode ser conectado a cerca de cinco milhões de outros neurônios; milhares de genes, então, podem estar envolvidos no processo da puberdade. A importância funcional e hierárquica de cada um desses genes no controle dos neurônios GnRH, juntamente com outros fatores neuronais e gliais, pode diferir entre as espécies. Existem, no entanto, componentes fundamentais que parecem ser comuns a todos os mamíferos e que se situam nos níveis hierárquicos mais elevados, ajudando a compreender a progressão do processo puberal. Assim, todas as espécies de mamíferos estudadas, por exemplo, têm aglomerados de neurônios kisspeptinérgicos (que secretam kisspeptina), envolvidos na regulação da secreção tônica e secreção cíclica de GnRH, que também se classifica como o elemento mais alto na hierarquia desse complexo neuronal após considerar os neurônios GnRH. -/- Sabe-se que o eixo hipotálamo-hipofisário-gonodal está ativo desde as primeiras fases da vida do indivíduo, mesmo antes do nascimento em certas espécies. A secreção de GnRH, no entanto, é suprimida mais tarde no desenvolvimento e permanece dessa forma até o período pré-púbere, quando será reativada gradualmente. -/- Por várias décadas, a supressão e reinicialização dos pulsos de GnRH foi atribuída a uma hipótese conhecida como teoria gonadostat que afirma que o centro tônico do hipotálamo é inibido devido à sua sensibilidade ao mecanismo de feedback negativo dos esteroides gonodais, é aumentado; portanto, o GnRH e a consequente secreção de gonadotrofinas (FSH e LH) são insuficientes para a ocorrência da maturação folicular e espermatogênese. O centro cíclico é composto por uma segunda subpopulação de neurônios GnRH que é reativada por meio de uma complexa interação entre vários sistemas neuronais inibitórios (que devem reduzir progressiva-mente sua influência) e outros sistemas excitatórios, que, por sua vez, operam por meio de diferentes neurotransmissores, como o ácido γ-amino-butírico (GABA) e seus receptores, glutamato, óxido nítrico e neuropeptídio Y (NPY). Esses fatores, juntamente com as alterações morfológicas observadas nos neurônios do GnRH à medida que a puberdade se aproxima, e com as interações e sinais aferentes das células gliais, levam a um padrão de progressão linear que culminará na reativação do centro cíclico. Esse processo era conhecido anteriormente como teoria da maturação central e faz parte das mudanças que configuram o processo para chegar à puberdade. A elevação nas concen-trações de estradiol subsequente à reativação gradual do centro gerador de pulso tônico GnRH provavelmente permitirá a maturação final do centro cíclico. -/- A forma como cada organismo estabelece o momento certo para iniciar as mudanças que levam à puberdade é conhecido; a existência de algum mecanismo neurobiológico que constitui um relógio interno pode ser considerada. No entanto, esse mecanismo afetaria principalmente o desenvolvimento neuronal no nível central; também seria difícil compará-lo com a maneira pela qual fatores externos ao indivíduo afetam o início da puberdade. Nessa perspectiva, um sistema que permita receber informações completas sobre o crescimento e desenvolvimento do indivíduo poderia ser mais prático. Os mediadores desse sistema incluem o hormônio do crescimento, IGF-I, leptina e outros substratos metabólicos. A leptina em particular, que sinaliza as reservas de tecido adiposo, é um dos elementos mais importantes e, embora não determine quando começa a puberdade, se atua como fator permissivo para que o processo progrida, uma vez que excede um nível limite. A consideração do estágio de desenvolvimento do animal para o início da puberdade era anteriormente conhecida como o peso corporal crítico ou teoria do lipostato. É importante considerar que as três teorias mencionadas não são exclusivas. -/- O mecanismo da puberdade nos machos é semelhante ao já descrito; entretanto, deve-se lembrar que no macho o centro cíclico não está ativo. À medida que a puberdade se aproxima, o crescimento testicular é desencadeado e, em ruminantes e suínos, o pênis que estava preso à mucosa prepucial é gradualmente liberado. -/- -/- • _____FATORES QUE INFLUENCIAM A PUBERDADE -/- Os animais podem manifestar a puberdade de três formas diferentes. Pode ser tardia e o animal demorar para estar apto a reprodução; precoce e o animal entrar na vida reprodutiva antes do esperado ou pode ser normal e o animal estar com boa conformação e idade. Para tanto, alguns fatores podem interferir à manifestação da puberdade pelos animais como a genética, idade e peso, nutrição, fotoperíodo e o próprio manejo adotado. -/- -/- Genética -/- O genótipo afeta a idade da puberdade, pois algumas raças são anteriores a outras. Nos bovinos, as raças europeias atingem a puberdade antes dos zebuínos, isto é, uma novilha ou novilho da raça holandesa atinge a puberdade primeiro que os animais da mesma idade e do mesmo peso da raça nelore, por exemplo. -/- Da mesma forma, as porcas da raça chinesa Meishan atingem a puberdade por volta dos 115 dias de idade, metade da idade das raças brancas. As ovelhas de raças de corte, da mesma forma, são mais precoces que os produtores de lã. As raças pequenas, da mesma forma, são geralmente mais precoces, pelo menos em bovinos (jersey x guzerá) e em caninos. Os híbridos, por outro lado, apresentam puberdade mais precoce que os puros, devido ao efeito da heterose. Por este motivo, em certas espécies são utilizadas linhas híbridas. -/- -/- Idade e peso -/- A tabela 1 mostra a idade média de início da puberdade em espécies domésticas. O peso vivo (PV) adulto é mais relevante para a idade na puberdade nos ruminantes, enquanto em suínos é menos decisivo. A superalimentação também não é recomendada, pois pode alterar tanto os sinais que são recebidos pelo hipotálamo quanto sua resposta a eles. -/- Logo, o manejo alimentar adotado deve estar de acordo com as normas estabeleci-das pelos especialistas na área, principalmente no tocante as exigências nutricionais que devem servir de regra na propriedade. Sendo assim, os animais entrarão em puberdade com as taxas de alta qualidade o que afetará positivamente na prole futura e dará retorno lucrativo ao proprietário. -/- -/- Época do ano (Fotoperíodo) -/- Em fêmeas de espécies sazonais, como ovelhas e cabras, existem certos requisitos de fotoperíodo que devem ser atendidos para que a puberdade ocorra. Nessas espécies, um período de exposição a dias longos é necessário, seguido por outro de exposição a dias curtos. Na verdade, os cordeiros e cabritos nascidos fora da estação, mesmo que tenham atingido o peso necessário, terão que esperar até o outono seguinte (a estação reprodutiva) para atingir a puberdade. Os machos, por outro lado, não estão sujeitos a essas limitações nos requisitos fotoperiódicos para apresentar a puberdade. -/- Em novilhas nascidas no outono, por outro lado, a puberdade ocorre antes de um ano de idade, no verão seguinte ou no início do outono, mais cedo do que nas nascidas na primavera, devido à exposição a longos dias durante os primeiros seis meses do ano após seu nascimento aceleram seu crescimento. Em gatos, o aumento do fotoperíodo também acelera o início da puberdade. -/- Em ovelhas e novilhas, a primeira ovulação que ocorre ao entrar na puberdade é silenciosa; ou seja, não é acompanhada de sinais comportamentais de cio como a micção frequente, inchamento da vulva, uma montando a outra e deixando-se montar etc., pois para que esse comportamento se manifeste, o sistema nervoso necessita de uma pré-sensibilização com progesterona que não estará presente até o próximo ciclo, após o desenvolvimento do corpo lúteo vindo desta primeira ovulação. -/- -/- Sociossexual -/- A interação de indivíduos da mesma espécie ou a presença ou ausência de sinais de bioestimulação, como feromônios, pode afetar o período de puberdade. A puberdade, por exemplo, é atrasada em porcas criadas individualmente em comparação com porcas criadas em grupo. Além disso, na porca, ovelha e cabra, a exposição ao macho estimula as fêmeas e a puberdade aparece mais precocemente. -/- -/- Manejo -/- Certas práticas de manejo podem acelerar a puberdade, especialmente no período pré-púbere. Em porcas próximas à puberdade, por exemplo, o estresse causado por procedimentos, como o transporte de um local para outro ou a exposição ao macho, faz com que apareça o estro em torno de sete dias após a realização do manejo mencionado. -/- -/- • _____ESTACIONALIDADE REPRODUTIVA -/- A estacionalidade ou sazonalidade reprodutiva é uma estratégia evolutiva que se desenvolveu em algumas espécies; tende a tornar a reprodução mais eficiente. Nos países de latitudes distantes do equador, o objetivo é que as crias nasçam na primavera, época do ano mais favorável, graças à abundância de alimentos e às amenas condições climáticas. No caso da ovelha, cuja gestação dura cinco meses, para que os partos ocorram na primavera, ela deve engravidar no outono (figura 1), quando os dias são curtos; enquanto a égua, tendo uma gestação de aproximadamente 11 meses, deve conceber na primavera, quando os dias são longos; assim, o parto ocorrerá na primavera do ano seguinte (figura 2). -/- -/- Figura 1: Esquema ilustrativo da estacionalidade reprodutiva na espécie ovina. Ovinos e caprinos se reproduzem na época do ano em que os dias são curtos e os equinos quando são longos. O grau de sazonalidade depende da origem da raça. As raças nativas de países localizados em latitudes elevadas (> 50°,ovelhas: soay, blackface, suffolk; cabras: saanen, alpino francês, toggenburg; equinos: puro-sangue, hanoveriano) terão uma estacionalidade mais acentuada do que as latitudes menores ou mediterrâneas (ovelhas: merino; cabras: murciana granadina; equinos: quarto de milha). Também existem raças de latitudes próximas ao Equador cuja estacionalidade é baixa ou nula (ovelhas: raças de pelo, crioulas; cabras: raças africanas e asiáticas) (tabela 2). -/- Para a maioria das raças de ovinos e caprinos, a estação reprodutiva começa no final do verão e início do outono; caracteriza-se pela apresentação de ciclos estrais sucessivos, e termina no final do inverno, quando se inicia o anestro, que se caracteriza pela ausência de ovulação. Consequentemente, a pulsatilidade do LH também diminui, que agora é incapaz de induzir a maturação folicular, o aumento dos estrogênios, o pico pré-ovulatório de LH e, portanto, a ovulação. -/- Isso ocorre porque durante o anestro a sensibilidade do hipotálamo ao mecanismo de feedback negativo dos estrogênios e de outros fatores de origem não gonodal é aumentada. Ao aproximar-se da estação reprodutiva, a sensibilidade hipotalâmica diminui e o aumento da pulsatilidade do GnRH causa as mudanças que culminam na ovulação. Portanto, o mecanismo endócrino do anestro estacional é semelhante ao do anestro pré-púbere e de alguns outros tipos de anestro. -/- A estacionalidade é um bom exemplo da interação entre o meio ambiente e o sistema neuroendócrino, pois o organismo é capaz de traduzir um sinal externo ambiental, como o fotoperíodo, em um sinal hormonal interno, que neste caso é a melatonina. -/- A glândula pineal secreta melatonina durante as horas de escuridão. Os animais sazonais apresentam um ritmo reprodutivo endógeno, que é regulado por janelas de fotossensibilidade, determinadas por mudanças na duração do dia. O sinal luminoso é captado pela retina e conduzido, via nervo, pelo trato retino-hipotalâmico até o núcleo supraquiasmático, que funciona como o relógio biológico do corpo. Daí o sinal viaja para o núcleo para-ventricular, depois para o gânglio cervical e, finalmente, para a glândula pineal, que responde secretando melatonina (figura 3). -/- Nas ovelhas, a estação reprodutiva começa quando a duração do dia diminui e, naturalmente, a noite aumenta; na égua, ocorre quando os dias se alongam. -/- A primavera não é necessariamente a melhor época do ano em todas as regiões do globo. The artefacts produced by artists during their creation of works of art are very various: paintings, writings, musical scores, and so on. I have a general thesis to offer about the relations of artefacts and artworks, but within the confines of this article I shall mainly discuss cases drawn from the art of painting, central specimens of which seem to be autographic in Nelson Goodman's sense, namely such that even the most exact duplication of them does not count as (...) producing the same work of art. My view will be that an artwork (such as a painting) and its associated artefact are not identical, and nor is the artefact in any sense part of the painting in question,2 but that nevertheless it is still possible to maintain the view that paintings are autographic (which view I shall call l the autographic thesis). I shall proceed initially through presentation of some counter-examples to common assumptions as to the relations of artefacts and artworks, and then present an alternative 'representational' theory of their relations. De la nécessité et de l'utilité de développer une philosophie spécifique pour la technologie de la blockchain, mettant l'accent sur les aspects ontologiques. Après une Introduction qui met en évidence les principales orientations philosophiques de cette technologie émergente, dans La technologie blockchain j’explique le fonctionnement de la blockchain, en analysant les directions de développement ontologique de cette technologie dans Conception et modélisation. La section suivante est consacrée à la principale application de la technologie de la blockchain, Bitcoin, avec les implications (...) sociales de cette crypto-monnaie. Il suit une section de Philosophie dans laquelle j'identifie la technologie de la blockchain au concept d'hétérotopie développé par Michel Foucault et je l'interprète à la lumière de la technologie de notation développée par Nelson Goodman en tant que système de notation. Dans la section Ontologie, je présente deux voies de développement que j'estime importantes: une Ontologie narrative, basée sur l'idée d'ordre et de structure de l'histoire transmise à travers l'histoire narrative de Paul Ricoeur, et le système de l'Ontologie d'entreprise basé sur des concepts et des modèles d'entreprise, spécifiques au Web sémantique, que je considère comme le plus développé et qui deviendra probablement le système ontologique formel, du moins en ce qui concerne les aspects économiques et juridiques de la technologie de la blockchain. O exame ultrassonográfico é uma ferramenta diagnóstica de grande relevância na rotina veterinária, uma vez que, apresenta ampla difusão entre os atendimentos de animais e permite a avaliação de órgãos e estruturas de forma não invasiva, segura e rápida, auxiliando na determinação de diversas afecções, levando ao tratamento adequado e contribuindo de forma positiva no prognóstico do paciente. Atualmente, em muitos casos, a avaliação testicular não faz parte da rotina ultrassonográfica em exames de ênfase abdominal, devido à sua localização anatômica (...) no escroto, podendo assim levar ao diagnóstico limitado e ao tratamento inadequado do paciente quando na ausência da avaliação dos testículos, posto que diversas são as afecções testiculares que podem acometer cães e que apresentam características ultrassonográficas de fácil detecção. Dentre as principais alterações observadas por meio da ultrassonografia, os casos de orquite, criptorquidismo, torção e também neoformações neoplásicas testiculares correspondem à maior casuística, sendo o método ultrassonográfico um exame com 98% a 100% de sensibilidade e acurácia para diagnóstico destas. Dessa forma, o objetivo deste artigo de revisão bibliográfica é elucidar a importância da avaliação testicular em exames ultrassonográficos de rotina, discorrendo inicialmente sobre os aspectos anatômicos e ultrassonográficos, e posteriormente acerca das afecções mais comumente diagnosticadas na rotina veterinária, apresentando ainda as alterações ultrassonográficas causadas no parênquima testicular. Currently, in many cases, testicular evaluation is not part of the ultrasound evaluation in exams with abdominal emphasis, due to its anatomical location in the scrotum, which can lead to limited diagnosis and inadequate treatment of the patient in the absence of ultrasound evaluation of the testicles, since there are several testicular affections that can affect dogs and that present ultrasonographic characteristics that are easily detected. Among the main alterations observed during ultrasonographic exams, cases of orchitis, cryptorchidism, torsion and also testicular neoplastic neoformations correspond to the largest sample, with the ultrasonographic method being an exam with 98% to 100% sensitivity and accuracy for their diagnosis. Thus, the aim of this literature review article is to elucidate the importance of testicular evaluation in routine ultrasound examinations, initially discussing the anatomical and ultrasound aspects, and later on the most commonly diagnosed conditions in the veterinary routine, also presenting the ultrasound changes caused in the testicular parenchyma. Tato recenzní studie sleduje analogii, na níž založil svoji metodu bádání i psaní Douglas R. Hofstadter v knize Gödel, Escher, Bach. Proti Hofstadterovu pojetí analogie, kromě jiného ilustrované zavádějícími příklady skladeb J. S. Bacha, je analogie v této studii precizována. Zároveň jsou ve studii napraveny nedostatky hudebních příkladů, jež by patrně neodhalili čtenáři bez přímé vazby na hudební teorii. Tyto aspekty sleduje tato studie až k závěru, že recenzovaná vlivná kniha, neprávem aspirující na metodologii veškerenstva, patří mezi poulárně naučnou (...) literaturu. (shrink)

Blame is multifarious. It can be passionate or dispassionate. It can be expressed or kept private. We blame both the living and the dead. And we blame ourselves as well as others. What’s more, we blame ourselves, not only for our moral failings, but also for our non-moral failings: for our aesthetic bad taste, gustatory self-indulgence, or poor athletic performance. And we blame ourselves both for things over which we exerted agential control (e.g., our voluntary acts) and for things over (...) which we lacked such control (e.g., our desires, beliefs, and intentions). I argue that, despite this manifest diversity in our blaming practices, it’s possible to provide comprehensive account of blame. Indeed, I propose a set of necessary and sufficient conditions that aims to specify blame’s extension in terms of its constitution as opposed to its function. And I argue that this proposal has a number of advantages beyond accounting for blame in all its disparate forms. For one, it can account for the fact that one’s having had control over whether one was to φ is a necessary condition for one’s being fittingly blamed for having φ-ed. For another, it can account for why, unlike fitting shame, fitting blame is always deserved, which in turn explains why there is something morally problematic about ridding oneself of one’s fitting self-blame (e.g., one’s fitting guilt). This paper provides a retrospective and prospective overview of TU Delft’s approach to engineering ethics education. For over twenty years, the Ethics and Philosophy of Technology Section at TU Delft has been at the forefront of engineering ethics education, offering education to a wide range of engineering and design students. The approach developed at TU Delft is deeply informed by the research of the Section, which is centered around Responsible Research and Innovation, Design for Values, and Risk Ethics. These theoretical (...) approaches are premised on the notion that technologies are inherently value-laden, and as such contain the possibility of fostering or hindering moral values. Each of these approaches encourages students to take a proactive attitude with respect to their projects and profession, thinking creatively about – and taking responsibility for – how to both prevent harm and do good via the technologies they help develop. To explain how this is put into practice, this paper sketches a brief history of ethics teaching at TU Delft, outlines current activities, and presents future plans for Bachelor and Master’s level engineering ethics education at TU Delft. As Socrates famously noted, there is no more important question than how we ought to live. The answer to this question depends on how the reasons that we have for living in various different ways combine and compete. To illustrate, suppose that I've just received a substantial raise. What should I do with the extra money? I have most moral reason to donate it to effective charities but most self-interested reason to spend it on luxuries for myself. So, whether I (...) should live my life as I have most moral reason to live it or as I have most self-interested reason to live it depends on how these and other sorts of reasons combine and compete to determine what I have most reason to do, all things considered. “Big Data” and data analytics affect all of us. Data collection, analysis, and use on a large scale is an important and growing part of commerce, governance, communication, law enforcement, security, finance, medicine, and research. And the theme of this symposium, “Individual and Informational Privacy in the Age of Big Data,” is expansive; we could have long and fruitful discussions about practices, laws, and concerns in any of these domains. But a big part of the audience for this symposium is (...) students and faculty in higher education institutions (HEIs), and the subject of this paper is data analytics in our own backyards. Higher education learning analytics (LA) is something that most of us involved in this symposium are familiar with. Students have encountered LA in their courses, in their interactions with their law school or with their undergraduate institutions, instructors use systems that collect information about their students, and administrators use information to help understand and steer their institutions. More importantly, though, data analytics in higher education is something that those of us participating in the symposium can actually control. Students can put pressure on administrators, and faculty often participate in university governance. Moreover, the systems in place in HEIs are more easily comprehensible to many of us because we work with them on a day-to-day basis. Students use systems as part of their course work, in their residences, in their libraries, and elsewhere. Faculty deploy course management systems (CMS) such as Desire2Learn, Moodle, Blackboard, and Canvas to structure their courses, and administrators use information gleaned from analytics systems to make operational decisions. If we (the participants in the symposium) indeed care about Individual and Informational Privacy in the Age of Big Data, the topic of this paper is a pretty good place to hone our thinking and put into practice our ideas. It seems that we can be directly accountable for our reasons-responsive attitudes—e.g., our beliefs, desires, and intentions. Yet, we rarely, if ever, have volitional control over such attitudes, volitional control being the sort of control that we exert over our intentional actions. This presents a trilemma: (Horn 1) deny that we can be directly accountable for our reasons-responsive attitudes, (Horn 2) deny that φ’s being under our control is necessary for our being directly accountable for φ-ing, or (Horn 3) deny (...) that the relevant sort of control is volitional control. Known as the Darwin of the twenty-first century, the German biologist Ernst Walter Mayr (1904-2005) studied a great variety of subjects such as Ornithology, Genetics, Evolution, Classification, History, and Philosophy of Biology. This scientist was a giant of the previous century and an icon of Evolutionary Biology. He became famous for his Biological Species Concept and his conclusion that allopatry is the main cause for the origin of species. He provided a decisive contribution to the New Systematics and was the (...) pioneer of the punctuated equilibrium idea. Mayr was one of the main architects of the evolutionary synthesis as also of the Neo-Darwinian wave. Evaluated together, all of his works reveal several elements of his ambition – to organize a philosophical conception inherent for Biology. An assiduous defender of autonomous Biology, Mayr asserted that four sets of factors in Biology differ from those in the Exact Sciences: (I) refutation of essentialism, mechanism, vitalism, and teleology; (II) some physical principles cannot be applied to Biology; (III) absence of general laws in Biology; and (IV) basic principles of biology and their specific character cannot be applied to the inanimate world. The present study took as an axis a minor or even invisible theme from the Ernst Mayr literature and aims to analyze critically the theoretical and epistemological basis that subsidizes – or not– the affirmation that Biology is an autonomous Science. - O biólogo alemão Ernst Walter Mayr (1904-2005), conhecido como o Darwin do século XXI, trabalhou com uma grande variedade de temas: Ornitologia, Genética, Evolução, Classificação, História e Filosofia da Biologia. Esse cientista foi um dos gigantes do século XX e um ícone para a Biologia Evolutiva. Ficou famoso com o seu Conceito Biológico de Espécie e sua conclusão de que a alopatria era a principal causa da origem das espécies. Forneceu uma contribuição decisiva à Nova Sistemática, foi precursor da ideia de equilíbrio pontuado e um dos principais arquitetos da síntese evolutiva, bem como do movimento Neodarwinista. Quando avaliados em conjunto, seus trabalhos revelam os diversos elementos de sua ambição – organizar um corpo de concepções filosóficas próprias da Biologia. Defensor assíduo de uma Biologia autônoma, Mayr afirmou que há quatro conjuntos de fatores que diferenciam a Biologia do conjunto das Ciências Exatas: (I) refutação do essencialismo, do mecanicismo, do vitalismo e da teleologia; (II) convicção de que certos princípios da Física não podem ser aplicados à Biologia; (III) ausência de leis naturais universais em Biologia; e (IV) percepção do caráter único de certos princípios básicos da Biologia não aplicáveis ao mundo inanimado. The performance of one option can entail the performance of another. For instance, I have the option of baking a pumpkin pie as well as the option of baking a pie, and the former entails the latter. Now, suppose that I have both reason to bake a pie and reason to bake a pumpkin pie. This raises the question: Which, if either, is more fundamental than the other? Do I have reason to bake a pie because I have reason to (...) perform some instance of pie-baking—perhaps, pumpkin-pie baking? Or do I have reason to bake a pumpkin pie because I have reason to bake a pie? Or are they equally fundamental, as they would be if, say, I had reason to do each because each would have optimal consequences? The aim of this paper is to compare two possible answers to this question—omnism and maximalism—and to argue that the latter is preferable. Roughly speaking, maximalism is the view that only those options that are not entailed by any other option are to be assessed in terms of whether they have some feature (such as that of having optimal consequences), whereas omnism is the view that all options are to be assessed in terms of whether they have this feature. I argue that there are at least two reasons to prefer maximalism, for it is able to overcome two critical problems with omnism. (shrink)

Roughly speaking, maximalism is the view that only those options that are not entailed by any other option are to be assessed in terms of whether they have some right-making feature F (such as that of having optimal consequences), whereas omnism is the view that all options are to be assessed in terms of whether they are F. I argue that maximalism is preferable to omnism because it provides a more plausible solution to the problem of act versions and is not subject to any problems of its own. And if I’m right about maximalism’s being preferable to omnism, then most moral theories, which are all versions of omnism, need significant revision. (shrink)

Statutory interpretation involves the reconstruction of the meaning of a legal statement when it cannot be considered as accepted or granted. This phenomenon needs to be considered not only from the legal and linguistic perspective, but also from the argumentative one - which focuses on the strategies for defending a controversial or doubtful viewpoint. This book draws upon linguistics, legal theory, computing, and dialectics to present an argumentation-based approach to statutory interpretation. By translating and summarizing the existing legal interpretative canons (...) into eleven patterns of natural arguments - called argumentation schemes - the authors offer a system of argumentation strategies for developing, defending, assessing, and attacking an interpretation. Illustrated through major cases from both common and civil law, this methodology is summarized in diagrams and maps for application to computer sciences. Some right acts have what philosophers call moral worth. A right act has moral worth if and only if its agent deserves credit for having acted rightly in this instance. And I argue that an agent deserves credit for having acted rightly if and only if her act issues from an appropriate set of concerns, where the appropriateness of these concerns is a function what her ultimate moral concerns should be. Two important upshots of the resulting account of moral worth (...) are that (1) an act can have moral worth even if it doesn’t manifest a concern for doing what’s right and that (2) an act can lack moral worth even if it is performed for the right reasons. I argue that rule consequentialism sometimes requires us to act in ways that we lack sufficient reason to act. And this presents a dilemma for Parfit. Either Parfit should concede that we should reject rule consequentialism (and, hence, Triple Theory, which implies it) despite the putatively strong reasons that he believes we have for accepting the view or he should deny that morality has the importance he attributes to it. For if morality is such that we sometimes have decisive reason (...) to act wrongly, then what we should be concerned with, practically speaking, is not with the morality of our actions, but with whether our actions are supported by sufficient reasons. We could, then, for all intents and purposes just ignore morality and focus on what we have sufficient reason to do, all things considered. So if my arguments are cogent, they show that Parfit’s Triple Theory is either false or relatively unimportant in that we can, for all intents and purposes, simply ignore its requirements and just do whatever it is that we have sufficient reason to do, all things considered. When evidence-based policymaking is so often mired in disagreement and controversy, how can we know if the process is meeting its stated goals? We develop a novel mathematical model to study disagreements about adequate knowledge utilization, like those regarding wild horse culling, shark drumlines and facemask policies during pandemics. We find that, when stakeholders disagree, it is frequently impossible to tell whether any party is at fault. We demonstrate the need for a distinctive kind of transparency in evidence-based policymaking, which (...) we call transparency of reasoning. Such transparency is critical to the success of the evidence-based policy movement, as without it, we will be unable to tell whether in any instance a policy was in fact based on evidence. (shrink)

This paper concerns Warren Quinn’s famous “The Puzzle of the Self-Torturer.” I argue that even if we accept his assumption that practical rationality is purely instrumental such that what he ought to do is simply a function of how the relevant options compare to each other in terms of satisfying his actual preferences that doesn’t mean that every explanation as to why he shouldn’t advance to the next level must appeal to the idea that so advancing would be suboptimal in (...) terms of the satisfaction of his actual preferences. Rather, we can admit that his advancing would always be optimal, but argue that advancing isn’t always what he ought to do given that advancing sometimes fails to meet some necessary condition for being what he ought to do. For instance, something can be what he ought to do only if it’s an option for him. What’s more, something can be what he ought to do only if it’s something that he can do without responding inappropriately to his reasons—or, so, I argue. Thus, the solution to the puzzle is, I argue, to realize that, in certain circumstances, advancing is not what the self-torturer ought to do given that he can do so only by responding inappropriately to his reasons. For a symposium on Douglas W. Portmore's Commonsense Consequentialism: Wherein Morality Meets Rationality.

Using tools like argument diagrams and profiles of dialogue, this paper studies a number of examples of everyday conversational argumentation where determination of relevance and irrelevance can be assisted by means of adopting a new dialectical approach. According to the new dialectical theory, dialogue types are normative frameworks with specific goals and rules that can be applied to conversational argumentation. In this paper is shown how such dialectical models of reasonable argumentation can be applied to a determination of whether an (...) argument in a specific case is relevant are not in these examples. The approach is based on a linguistic account of dialogue and text from congruity theory, and on the notion of a dialectical shift. Such a shift occurs where an argument starts out as fitting into one type of dialogue, but then it only continues to makes sense as a coherent argument if it is taken to be a part of a different type of dialogue. The aim of the paper is to present a typology of argument schemes. In first place, we found it helpful to define what an argument scheme is. Since many argument schemes found in contemporary theories stem from the ancient tradition, we took in consideration classical and medieval dialectical studies and their relation with argumentation theory. This overview on the main works on topics and schemes provides a summary of the main principles of classification. In the second section, Walton’s theory is (...) briefly explained to introduce the schemes classification and its different levels. Imagine both that (1) S1 is deliberating at t about whether or not to x at t' and that (2) although S1’s x-ing at t' would not itself have good consequences, good consequences would ensue if both S1 x's at t' and S2 y's at t", where S1 may or may not be identical to S2 and where t < t' ≤ t". In this paper, I consider how consequentialists should treat S2 and the possibility that S2 will y at (...) t". At one end of the spectrum, consequentialists would hold that, in deciding whether or not to x at t', S1 should always treat S2 as a force of nature over which she has no control and, thus, treat the possibility that S2 will y at t" as she would the possibility that a hurricane will take a certain path. On this view, S1 is to predict whether or not S2 will y and act accordingly. At the other end of the spectrum, consequentialists would hold that S1 should always treat S2 as someone available for mutual cooperation and, thus, treat the possibility that S2 will y at t" as something to be relied upon. On this view, S1 is to rely on S2’s cooperation and so play her part in the best cooperative scheme involving the two of them. A third and intermediate position would be to hold that whether S1 should treat S2 as a force of nature or as someone available for mutual cooperation depends on whether S1 can see to it that S2 will y at t" by, say, having the right set attitudes. I’ll argue for this third position. As we’ll see, an important implication of this view is that consequentialists should be concerned not just with an agent’s voluntary actions but also with their involuntary acquisitions of various mental attitudes, such as beliefs, desires, and intentions. Indeed, I will argue that consequentialists should hold both that (1) an agent’s most fundamental duty is to have all those attitudes that she has decisive reason to have and only those attitudes that she has sufficient reason to have and that (2) she has a derivative duty to perform an act x if and only if her fulfilling this fundamental duty ensures that she x’s. Thus, I argue (as Donald Regan did before me) that consequentialism should not be exclusively act-orientated – that it should require agents not only to perform certain voluntary actions but also to have certain attitudes. In the process, I develop a new version of consequentialism, which I call attitude-consequentialism. The precarious rights of senior citizens, especially those who are highly educated and who are expected to counsel and guide the younger generations, has stimulated the creation internationally of advocacy associations and opinion leader groups. The strength of these groups, however, varies from country to country. In some countries, they are supported and are the focus of intense interest; in others, they are practically ignored. For this is reason we believe that the creation of a network of all these associations (...) is essential. The proposed network would act as a support for the already-existing policies of the United Nations’ High Commission for Human Rights, of independent experts, and of the Global Alliance for the Rights of Older People. All three have long ago recommended the creation of a recognized instrument for uniting presently scattered efforts. The proposed network, therefore, will seek to promote the international exchange of relevant expertise, and it will reinforce the commitments and actions that single countries are currently taking to meet these objectives. For example, informative public events can be organised to promote particular support initiatives and to provide an opportunity for new members of the network to be presented. The network will promote health for senior citizens, disease prevention, senior mobility, safe free time for seniors, alimentary education, protection against new risks and dangers, as well as equity in the services necessary for seniors to adopt new information and communication technologies. In the case of retired academic members, the network will promote equality with respect to continuing use of digital technologies (particularly email), continuing access to research libraries, and the guaranteed ability for seniors to fund their own research programs and to deliver free seminars. With the advent of the semantic web, the problem of ambiguity is becoming more and more urging. Semantic analysis is necessary for explaining and resolving some sorts of ambiguity by inquiring into the relation between possibilities of predication and definition of a concept in order to solve problems such as interpretation and ambiguity. If computing is now approaching such problems of linguistic analysis, what is worth inquiring into is how the development of linguistic studies can be useful for developing the (...) theoretical background of ontologies. Our proposal is to develop a theory of definition alternative to the traditional metaphysical approach and the modern relativistic account. We interpret the ancient notion of essential definition in a dialectical perspective, and show how the dialectical definition by genus and difference corresponds to the semantic analysis of the definiendum. The dialectical definition is shown to be grounded on the deepest endoxa (shared knowledge) of a community, and to be the argumentatively strongest definition. After presenting the most common types of definition used in argumentation, the linguistic and logical characteristics of the notion of definition by genus and difference are set out in a pragmatic framework. Crime-preventing neurointerventions (CPNs) are increasingly being used or advocated for crime prevention. There is increasing use of testosterone-lowering agents to prevent recidivism in sexual offenders, and strong political and scientific interest in developing pharmaceutical treatments for psychopathy and anti-social behaviour. Recent developments suggest that we may ultimately have at our disposal a range of drugs capable of suppressing violent aggression, and it is not difficult to imagine possible applications of such drugs in crime prevention. But should neurointerventions be used in (...) crime prevention, and may the state ever permissibly impose CPNs as part of the criminal justice process? It is widely thought that preventing recidivism is one of the aims of criminal justice, yet existing means of pursuing this aim are often poorly effective, restrictive of basic freedoms, and harmful. Incarceration, for example, tends to be disruptive of personal relationships and careers, detrimental to physical and mental health, highly restrictive of freedom of movement and association, and rarely more than modestly effective at preventing recidivism. Neurointerventions hold the promise of preventing recidivism in ways that are more effective and more humane, but the use of CPNs in criminal justice raises several ethical concerns. CPNs could be highly intrusive and may threaten fundamental human values, such as bodily integrity and freedom of thought, and humanity has a track record of misguided, harmful, and unwarrantedly coercive use of neurotechnological ‘solutions’ to criminality. This collection brings together original contributions from emerging scholars and internationally renowned moral and political philosophers to address these issues. (shrink)
